Class – What we have to determine here is when the accident occurs, is James in the
scope of employment or is he on a frolic or and errand. Here are two scenarios with
additional facts. See, I purposely leave out some facts so we can add them in as the
week goes on here…An explanation for you crying about incomplete facts!!! LOL
Scenario one: James leaves and gets into his own vehicle that he is reimbursed for
using by Acme including gas. James is leaving to go meet a client to assess a future
purchase agreement between the client and Acme.
Scenario two: James leaves the lunch where a co-worker paid for the lunch including
the beer and James got into his car and left in a hurry knowing that he was running late
for his son’s baseball game that he forgot about.
How do these scenarios affect Acme’s exposure to liability?
